These Terms of Service (“Terms”) govern your use of SparkFuel (the “App”), provided by HB Apps (“we,” “our,” or “us”). By downloading, installing, or using SparkFuel, you agree to these Terms.
If you do not agree to these Terms, do not use the App.
You must be at least 13 years old to use SparkFuel. If you are under the age of majority in your jurisdiction, you may use SparkFuel only with permission of a parent or legal guardian.
SparkFuel is a general wellness and fitness tracking app. SparkFuel is not a medical device and does not provide medical advice, diagnosis, or treatment.
Always consult a qualified healthcare professional before making significant dietary, fitness, or health-related decisions.
Do not ignore professional medical advice based on information from SparkFuel.

Feature availability may vary by device, operating system version, permissions, region, and network availability.
SparkFuel integrates with Apple HealthKit only with your explicit permission. You can revoke permissions at any time in iOS settings.
Your use of health and personal data is governed by our Privacy Policy: PRIVACY_POLICY.md (and the public URL version once hosted).
You are responsible for reviewing and understanding the Privacy Policy before using SparkFuel.
SparkFuel may provide AI-assisted nutrition estimates from:

SparkFuel currently does not require a separate SparkFuel account login for core usage. You are responsible for:

We may limit or suspend access to features if misuse, abuse, or security risk is detected.
SparkFuel, including its design, code, branding, and content (excluding your personal data), is owned by HB Apps and protected by applicable intellectual property laws.
You receive a limited, non-exclusive, non-transferable, revocable license to use SparkFuel for personal, non-commercial use, subject to these Terms.
SparkFuel depends on third-party platforms and services, including Apple HealthKit, CloudKit/iCloud, and AI infrastructure providers.
We are not responsible for outages, data loss, delays, or policy changes caused by third-party services.
Your use of third-party services is also subject to their own terms and privacy policies.
You are responsible for managing your own data retention and backups where applicable.
If iCloud sync is enabled, data may be stored in your private iCloud container according to Apple systems and policies.
Deleting the app may remove local app data but may not automatically remove all HealthKit or iCloud-synced records.
SparkFuel is provided on an “AS IS” and “AS AVAILABLE” basis to the maximum extent permitted by law.

To the maximum extent permitted by law, HB Apps and its affiliates, officers, employees, and licensors are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of SparkFuel.
To the maximum extent permitted by law, our total liability for claims relating to SparkFuel is limited to the amount you paid for the App in the 12 months preceding the claim (or USD $0 if the App was free).
Some jurisdictions do not allow certain liability limitations; in those cases, this section applies to the fullest extent allowed.
You agree to defend, indemnify, and hold harmless HB Apps from and against claims, liabilities, damages, losses, and expenses arising from:
You may stop using SparkFuel at any time by uninstalling it.
We may suspend or terminate access to features if required for security, legal, or abuse-prevention reasons.
Sections that reasonably should survive termination (including disclaimers, liability limitations, and intellectual property) will remain in effect.
We may update these Terms from time to time. If we make material changes, we will update the “Last Updated” date and may provide in-app notice.
Your continued use of SparkFuel after updates become effective constitutes acceptance of the revised Terms.
These Terms are governed by applicable laws in the jurisdiction where SparkFuel is offered and used, unless mandatory local law requires otherwise.
Any disputes will be handled by courts with proper jurisdiction, subject to applicable consumer protection law.
